Quick question: why can't IEBC just give NASA access to the servers. This will rest the case, unless something fishy happened. Looks like this case is hinged on server access. Also Orengo told IEBC during results transmission that they would accepts results if they were given access to the servers.

A better way, and I suspect the court may move in that direction, is to take it upon itself as a court to have court appointed experts to look into the IEBC systems as they stand today, and give a report to the court on whatever findings under the circumstances, as well as highlighting what is practicable and what is not in line with the request before it.

The challenge is that the petitioner is the one with the burden of proof to prove fraud and present evidence. That makes it hard for the petitioner and it seems the aim of IEBC and UMK team is to proof that is not possible given time.

It like when you notice cash is missing from your Mpesa acct and then demand Safcom to allow you access t0 check their servers and identify when your chums dissipated to to!

People just don't get it! Even if they get access to servers they will ask for something else, again and again.Finally there's something that will be impossible to provide,after which they will continue singing songs. remember hassan,chebukati etc etc. A never ending story. Its a pity really that a section of the population believes without question that election was stolen. This fuels tribal hate.

Of course there is still the issue of ‘hacking’ and computer generated vifarangas – blah blah blah. Net effect, everything is just one big mess.

So there was no election, - solution nusu Mkate.

Nusu Mkate is a pipe dream for NASA if that is their intent with the case or rejection of results. I support Ngalaka opinion that Supreme Court should independently look at "access to the servers " and rest this case after which NASA can go yap and cry all they want since it would have been proved that all they want was nusu mkate by all means.

Ngatia is polished. Took time to listen to him and Grand Mulla and was wowed. Though, Grand mulla has a long way to go to prove his Senior Counsel title, otherwise I doubt it.

Is it just my bias or do the judges listen more keenly to some lawyers than others? I could sense that when Ngatia and Muite were speaking they listened more intently, at one point Muite was going on and on even after the clock showed that his time was up, they did not interrupt him. I noticed a sense of impatience on the judges part when Orengo was speaking and also with young lawyers like Kanjama and Omollo.

Do you notice that its the media that showed you the clock? Muite went on to express himself for another minute of 2. The judges will stop you when you are out of order. Kanjama/Kinyanjui have not been admitted to court as Amicus or interested parties yet they wanted to interrupt and give their opinions - Totally out of order. Orengo was inconsistent "give us 30 mins....nonono 1hr......" anyone would grow impatient esp with the time constraint

Orengos 10 minutes ran to over 30 minutes and all along he was saying nothing. Ngatia spent less than 5 minutes and delivered the killer punch

Grand Mulla is useless when it comes to law he only shines in the media. That other idiot, Kanjama thought that just because he is a tv celeb, the CJ would be intimidated.
I think Orengo, Ngatia and Muite were very respected and respectable and of course the AG lighting up the room.

Its amazing house Muite is such refined. Had he not wasted his time in politics, in that Safina thing, he would be on the other side of the bench helping in making a decisive ruling. He is well composed, time conscious, and decisive.

When Orengo gets his six hours tomorrow, i am sure a lot of people will doze off. He is too entangled in NASA politics.

If the whole discussion is about servers ODM/CORD/NASA has lost the case.... even if they get access to the servers/database there is nothing there.
