They then went ahead to have him convicted of that (lesser)crime.
Now once it is establishes in court that a crime, was committed the province of sentencing belongs to the court as guided by relevant law.

I understand the law prescribed a harsher sentence than what the court eventually handed as a result of the mitigation.

That story alludes to a loveless marriage where there was little respect for the man.
