High voltage political cases can easily destroy a court, and in turn impact the public's confidence in the judicial system. All you need is a political demagogue telling 'his' base that hii ni court bandia!
Look at what happened to ICC for instance!

This vulnerabilities are especially true in young democracies like ours.
So to preserve the courts crucial trust amongst the populace as an arbiter in disputes, it is important that we dont send it a trojan horse

Yep. We need someone with balls of steel for that seat. Not a coward like Smoking. Someone the whole country can look up to and trust for that crucial decision regarding presidential petitions. After all handling presidential petitions is one of the key duties for the CJ job.

Have you read the job description of the CJ?


Yes. He or she is the head of the supreme court that handles the presidential petitions.


His decision of opting to disqualify himself from Justice Rawal's /Tonui's case brings out this character. Running away from thorny issues at hand.

The current interviewee is being bulldozed into accepting he is not suitable. They forget that when the high court asked them to consider the other applicants they could have easily have given valid reasons on why they dropped them. Asking to interview them all and then come and bulldoze and try to destroy them infront of the entire country is in bad taste. Very unprofessional.

Actually, Justice Odunga did not order them to interview them but asked them to reconsider. The carpenter should never have made it to the interview and even he acknowledged that. The JSC just needed to give the reasons why they shortlisted those they did. If you look at the interview today, the ambassador was dropped for three reasons..Not having experience as a lawyer in court, missing documents and for being a commissioner of the defunct ECK. That was very clear from the questioning he went through. So why embarrass him for 3 hours yet they had a good chance to come clear? Sounded like there was a personal vendetta against him. It is the civil society that went to court and even then it was because of the buffalo guy.

@marko, I think reasons must have been communicated to the candidate but still they have an option of withdrawing from the interview at any stage, Commissioner Warsame actually asked the candidate after a the first few questions whether he still wants him to continue..... Why din’t he decline?
