There is a vacancy for 3 positions. This is probably the only time in history that there will be these many vacancies in the 7 judge bench unless they increase the size of the court. At least one of the occupants will have to be a woman though I can imagine there will be lobbying to have two so that the ratio will meet the constitutional threshold of no more than two thirds.

The positions will be highly contested. There will be pressure to balance not only gender but also ethnic diversity. The big unrepresented communities are Kamba and Kalenjin. The JSC would also be wise to consider promotion from within current judges otherwise they may get protests from within the Judiciary if all the big appointments go to outsiders. There are 26 Court of Appeal judges and 83 High Court judges so there will be many applicants from there.

So who are the front runners?

Githu Muigai?
Miguna Miguna?
Grand Mulla?
Abdikadir Mohammed?
Isaac Lenaola?
Mumbi Ngugi?
Martha Koome?
Agnes Murgor?

Betty Murungi ama? I think she is also up there. I think the competition for the women seat(s) will be very stiff.

If Makau Mutua applies so should Miguna and if one of them is chosen so must the other and then we will have a balanced court. These 2 can never agree on anything. There will be 2 polar opposite factions on the bench and this is good because it means every judgement will have been scrutinized from all angles.

What a terrible list, those marked in red should never get anywhere near the bench. Same for all politicians.

There must be some good candidates from within the judicial system (high court and appeal court), we should look there.
