The law says no one should encroach on anyone's land including govt road reserves. It also says that no one should put up illegal/unapproved/unsanitary structures within the city or any other jurisdiction. You cannot purport to support an illegality. The law gives the land owner (in this case the govt) the right to develop/utilise his land in any way he deems fit. And to remove any illegal structures within their land.

In this case there are at least three reasons that would suffice to file a petition in court:

1. Contracts, rights and privileges, and exemptions to certain laws may be achieved implicitly and constructively

2. Correct interpretation of law isn't always straight forward

3. Certain interpretations of law may not optimal with respect to the welfare of the country

As such, if a party in any relationship may find such reasons to hold, then that party has right to seek legal redress. These conditions hold in this particular case and therefore my support is qualified.

NKT. Kibera is GOVERNMENT land. Its not under anyone's title. I have worked there in many Water and Sanitation Projects and wonder why the residents are blocking the GoK from developing public infrastructure in its own land.

that is where you go wrong! just because adjudication has not happened it does not mean it' "government land". this british type thinking about the crown owning everything and we are living at it's mercy is what has made government big headed. land is a resource and belongs to the community that stays there. titles are to facilitate trading and using it as collateral first not identity. government just works to adjudicate land to facilitate owners transact with the land.
another point is citizenship! An ID is not the document that makes you a citizen but it just shows you are a registered citizen! the document is to be used to demonstrate your 'citizenship' to others who are curious about your citizenship but does not make you a citizen. Citizenship and Land ownership are not derived from the state.

Great! I normally use this link road and it is amazing it can at times take one 10 minutes to drive from Ngong road to langata road via the link. Main challenge remains the traders who operate along the road in the Kibera stretch
