In civilised society the right thing to do is to embrace dialogue when it is requested.
There are certain caveats to this though; those so requesting need to demonstrate genuineness, sincerity and reasonableness. The agenda and feasibility on path to resolution have to make sense.
The matter at hand here is disbanding IEBC and constituting a new one.
What is clear on the outset is that this is an exercise aimed at using a route other than what the law requires – disregard the law and use alternative means! The constitution is less than a decade old.
None of those in active politics today, can claim to have pushed for the adoption of the constitution more than Raila. In fact he got exactly what he wanted against the wish of many in PNU who wanted some improvements and went ahead to reserve and pay for hotel space in Naivasha for that purposed but their effort were spurned by him. Any way that’s a different affair.
The million dollar question is why don’t CORD want to use the laid down procedures in law to achieve their goal!!
Your guess is as good as mine but I suspect it’s because they cannot raise the numbers nor prove a case in court! So they resort to alternative means! Doesn’t that amount to short circuiting democracy! In democracy you either put up in the polls, gather the requisite numbers or you........
If in this case we resort to bypassing the laid down structures(Cord wants dialogue involving civil society et al),where else will similar prescriptions be applied.
Think of the can of worms this opens. The next day Uhuru may decide to invite some cronies of his and then proceed to make some far reaching changes.
Bear in mind that this is the second time this term, that CORD is asking for “dialogue” in unclear circumstances.
I am not a jubilee supporter but I believe the opposition should aspire and demonstrate themselves to be better than those in power. They should assert themselves as sticklers to the law and hold the Government to account on its record in adhering to the law, not encouraging it to go to bed with it to circumvent the law.
Cord should be prepping themselves and going round in the Country to woo the electorate to put them in power in the next election cycle. Given the issues that Jubille have sullied themselves with – skyrocketing corruption, economic squeeze on the common guy on the streets etc, a serious, sellable and well organised opposition could beat them on the ballot.
But the open secret is that Cord as it stands today have snowball’s chance in hell of making any headway. That is probably why they have elected to engage in the shenanigans we are seeing – demonstrations, pleading for a meeting – to be hosted by the Government where the protocols et al will be controlled by state house!
Such an opposition does not deserve my support. It is batter to support Prof Ole Kiyapi.
