Quote:
Migori Governor Okoth Obado tarmacked a private road leading to the village home of Justice Jackson Ojwang, while he sat on a Supreme Court bench hearing an election petition against the governor.

The petition was dismissed.

For this reason, nine people have petitioned Chief Justice Willy Mutunga to investigate Ojwang.

The Judicial Service Commission has apparently confirmed that the central figures in the Judge Tunoi bribery scandal did meet at a petrol station on Waiyaki Way.

"An analysis of the phone records of key players shows that they all converged at Petro petrol station along Waiyaki Way on August 27, 2014 and that the actors were tracked through IMEI and CDR as their calls were reflected in the informant's mobile phone," Bilali told the JSC committee.

The phone records were analysed by the National Intelligence Service who also confirmed other communication between the various players including Tony Tunoi, son of the judge, John Osogo, an aide to the governor, Mike Njeru, a businessman, Kigen and Chirchir.

Kidero wrote:
Nairobi governor Evans Kidero told the JSC that he had never been in contact with his accuser Geoffrey Kiplagat.

“In the first place, I do not know Kiplagat. I have never met him but if I have I would not remember because as a governor I meet so many people but I clearly do not recall nor remember him. Secondly I have only seen the Judge ( Tunoi) on television and the closest I ever came to him was when my case was bieng heard and he was up on the bench and I have never greeted him, I have never talked to him,” reads the Hansard from JSC.

He said he knew businessman Mike Njeru but denied ever commissioning him to gain access to Justice Philip Tunoi.

Tonui wrote:
The judge denied ever meeting John Osogo, Mike Njeru or Geoffry Kiplagat at his office.

“I have never seen them in my office, they have not seen me in my office. I have not allowed any member of public to ring my office and no member of public has given me a phone to ring somebody and I deny having talked to Dr Kidero to ask for money,” the judge said.

“I state categorically that I have never been to any petrol station or restaurant to discuss or accept or receive a bribe. These in my view are allegations which have no substance at all,” said the judge.

In my opinion this judge will be found not guilty. He knows very well that the burden of proof is very high and that his accuser is a crook. I am now convinced that the judge ate the money and refused to share with the accuser but because he knows the law, he knew his accuser will never get any credibility in a court of law. Sad but true, the judge will be found innocent, he will retire honorably and go enjoy his millions in peace, Kiplagat will go back to drinking chang'aa and life will move on as normal for the rest of this majambazi country.

This judge has this whole setup figured out. There is only one accuser who does not have any witnesses and the accused who has all the witnesses. The tribunal will have no choice but to find him not guilty. He is a judge and he knows the system that is why he asked for a hearing in public. It is now Kiplagat who is on trial and it is not going well for him. I still believe he is the one telling the truth but that does not matter now because he has been outspent and outwitnessed.

Two Judiciary employees and another person working for Nairobi County on Thursday denied having had any contact with journalist Geoffrey Kiplagat, who has accused a Supreme Court judge of taking a bribe.

The three secretaries told a tribunal investigating the conduct of suspended Supreme Court Judge Philip Tunoi that they didn’t know Mr Kiplagat and had never seen him.
