I know there is another thread on Tunoi purely on kshs 200million bribery. However I would like to introduce an independent one not based on the bribe, but on a future event, that is the setting up of a tribunal to investigate the gross misconduct and misbehavious and all the sleeplessnesses that that the judge may have committed.
Now, I am a worried man because the tribunal that will be bound to be set up by the president will be consisting of seven members. Four of these members shall either be retired or serving judges (OMG!!!). The three members who are not judges are the least of my worries.
Consider this: All those judges that have so far retired under the old constitution did so at 70 years. I would not expect a retired judge to sit in that tribunal at 80 years of age, meaning that most likely the retired judges in that tribunal will be around 75 years of age. If this will be the case, then the retired judges will be the once that retired about 5 years ago utmost!! 5 years ago the judiciary was rotten to the core and there has been no significant gains in stemming out corruption in this institution. So, my concern is since I nolonger trust our judges, the serving and the retired ones in that tribunal will be birds of a feather with the same old dirty underhand dealings in that judiciary.
My main worries are:
1. If indeed Tunoi and his other colleagues collected the $2 million they could use the acquired financial war chest on the tribunal judges to influence the outcome of the findings.
2. In order to cover his tracks or defeat justice Quidero could throw in more dollars to the tribunal judges so that they could exonerate Tunoi against any wrong doing which is the only way to his (Quidero) freedom.
3. Quidero and Tunoi & company may combine forces in offering a much bigger bounty to the three members of the tribunal and perhaps one or two member judges. This is Kenya and anything is possible.
I might be right, I might be wrong, or am I taking my imaginations too far?smile smile

It's impossible not to have underhand deals where humans are concerned. The best outcome is the most expedient political course.

Qidro could play it smarter, the judge is found culpable of misconduct but exonerated from bribery which let's Qidro off the hook. Here the justice is offered a retirement package and the panel are also taken care of, win win scenerio.

I think the guy who should be very worried right now is Quidero because if Tonui is found guilty of the accusations then Quideros impeachment will definitely follow…
Actually Quidero should release more dollars to save Tonui and thereby save his own (Quidero) skin. My thoughts.
...besides, the presence of a safe alone does not signify that there is money inside...

Guys are acting like a decision hasn't already been made. All these are formalities. Its like the advertising of the job, that the candidate has already been chosen. Kenya has owners.

What happens if the judge tenders his resignation tomorrow or withdraws his case for retirement and retires tomorrow. I guess there is no need to form a tribunal, in which case this matter will not be investigated further, he gets to keep his 200m, full pension and benefits.

yes, he needs the wisdom right now. the flipside is if he resigns, he will appear to have been guilty.

@Baratang many more reasons to be worried. Are Kenyans ill-equipped to manage the affidavit age in the age of social media?

Not really. In Kenya major court cases are just a scorned business partner's way of demanding his share of the loot. Once that is sorted, the case and the headlines fade away into the sunset.
