as much as kenya is obligated to do so under the rome statute arresting bashir in kenya would leave a very vile taste in kibaki's mouth!

This is a very valid point. In all fairness,this guy should never have been invited to attend this memorable occasion in our history.

Can he be arrested after his passport has been stamped just before he boards the flight back to khartoum? then he will have been arrested in no mans land?

what Ultimatum? UNEP/UNHABITAT attempted to depart during the crescendo of PEV and it didn't workout - you know why? coz those wazungus who are at director level and above love it here, they have invested their life's earnings here. they are treated like kings/queens here. FYI: Bonn has an empty building waiting for UNEP and SA was ready to take the HQ but UNEP and UNHABITAT consist of the people not the furniture and if people were willing to retire and stay here during PEV then a small matter like Bashir will not be a big enough threat. its time you learnt the way of the world. Bashir is safe in Kenya and as much as it would please the West to have this guy behind bars, it won't happen in an African country so they should patiently wait for him to visit one of their countries for them to nab him.

obasanjo acted dumb under pressure from bush. storyline now is strikingly similar. invite was a mistake. but arresting a sitting president that you have invited let alone one who is an immediate neighbor would be a gigantic gaffe. unnecessary tension for kenya to live with since neither kenya nor sudan can relocate. meanwhile, the US would be watching the tension/conflict from afar. or maybe send another former sec-gen to feign concern.
