Judges were particularly keen to establish how long such an adjournment will be and what will change at the end of that period.

Judges Robert Fremr “why can’t the prosecution bring charges at later date if the case is dropped at present?”

Benjamin Gumpert “We know that there is evidence in existence. Not sure what that evidence will show.d'oh! d'oh! It may exonerate.”

But why postpone until the next election in Kenya? Why upto the election time? What is the connection?

I laughed when the lawyer for the victims suggested that the prosecution withdraws this case and looks for an easier one to prosecute!

This case will stay here till the west squeezes all it can from Kenya and by extent Africa.

@Simo, its clear there is no jurisdiction that could allow a case to proceed when and where the prosecution says it does not have evidence. The judges are prosecution are on same side.

I love the bit where the counsel for defense says they'll not provide more telephone numbers.

Media reporting on the case so far by CNN, BBC and Al Jazeera)

1. Regarding the dropped witnesses most reporting is focused on those who allegedly have been bribed or intimidated. I have so far heard only one mention of those who have been dropped because they said they had been coached or promised monetary rewards.

2. All these media houses are concentrating on the prosecutors report that Mr Kenyatta has used his influence as President to withhold "crucial"evidence. None of these three media houses are interrogating the fact that a) Mr Kenyatta was not president during the collection of evidence and confirmation of charges stage b)it is awkward that a case has been confirmed yet without sufficient evidence c) It is never the responsibility of the accused to incriminate himself by providing evidence against self.

3. Justice for the victims: None of these media houses are concerned on whether it could be possible that Mr Kenyatta is actually innocent and thus needs a fair trial. Justice for victims does not mean prosecuting a possibly innocent person just for the sake.

an indirect admission by both judges and otp that they would like the case to end. Could also be a discreet way of sending message to paymasters the direction the case is taking, so any necessary calls 4rom majuu can be made b4 ICC errs in final decision
