On 3rd of February 2010 my law firm was instructed by Malilili Ranch Limited to act alongside their lawyers Ms E K Mutua Advocates to facilitate compensation to various shareholders/farmers of the Company upon the sale of Konza farm to the Government. To my knowledge by the time I was instructed, the sale to the Government had long been concluded. On acceptance of the instructions several documents were released to me together with a sum of Kshs 44,998,890.00 by the above law firm on the 1st of March 2010. To enable me execute the instructions given by the Company I requested for further information and clarification . Upon not obtaining sufficient supporting documents/clarification I opted to withdraw from acting in the matter. Accordingly on or about the 18th of the same month March 2010, I returned all the said moneys totalling to Kshs 44,998,890.00 to the law firm which had paid the monies to me. I did not retain any monies neither did I even charge any fees on the matter. I then proceeded to close my file. That was my only interaction with the matter. I am therefore shocked by the recommendation to charge me with various offences related to this matter in which I only received instructions in my capacity as an Advocate and in which my firm did not in any event execute the instructions or receive a benefit but promptly withdrew from acting. I have faith in the ability of the institutions we have created under the constitution to fairly and objectively investigate the matter and deal conclusively with the same. As a long serving professional and public servant my integrity has never been in question and I look forward to final vindication by the truth
