Orengo had no power to distribute Land.The Government Lands Act(repealed)vested the power to alienate public land in the President.The said power was exercised through the then Commissioner of Lands....one Mr.Mabeya who I can tell you for free is in big problems...very big problems...

@maka... you have hit the nail on the head. Let's address WHAT! people get defensive you may find that Orengo may not even know nothing! It's like the current blaming of bwana Lenku - he know nothing other than what he is told! these people are placeholders - political appointees so to speak. Has anyone ever seen the old british comedy - YES MINISTER? Tafuta it and you will discover just how powerful and sly some of the people working below the minister are.

Oh comeon no one can have the guts of dishing out that amount of land without the blessing of some authority. I will take you back to 2012 who was busy dishing out title deeds? I will post links at a later hr

for me the land matter consists of two distinct things.

1. ownership of land as a result of irregular and fraudulent allocation of land.
2. ownership of land as a result of regular and above board allocation of land.

it has nothing to do with acreage (HOW MUCH). it has everything to do with... HOW the land was acquired. Kama hiyo shamba ya kaka yake alipata kwa njia mbaya - arudishe! but asirudishe kwa sababu ni mingi.

spot on. still wonder if it is possible for one to get that much acreage without ensuring that at least due process is followed and the legal formalities met. and wonder if the president has powers to revoke title to land - remember at least one case where the courts disagreed with that revocation stance.

I want to see who has the balls to go to court over this, the whole process was flawed, was the national land commission present to hand this public land? The new constitution was in place

62

(4) Public land shall not be disposed of or otherwise used except in terms of an Act of Parliament specifying the nature and terms of that disposal or use.

National Land Act

9. Conversion of land
(1) Any land may be converted from one category to another in accordance with the provisions of this Act or any other written law.
(2) Without prejudice to the generality of subsection (1)―
(a) public land may be converted to private land by alienation;

(b) subject to public needs or in the interest of defence, public safety, public order, public morality, public health, or land use planning,
public land may be converted to community land;
(c) private land may be converted to public land by―
(i) compulsory acquisition;
(ii) reversion of leasehold interest to Government after the expiry
of a lease; and
(iii) transfers; or
(iv) surrender.

I remember sometimes back reading an article in one of the dailies by Jaidi Kisero ( A writer whom I really respect) to that effect. I did not know it was this massive.

one of the Coast Mp from there quipped yesterday "that even the Governor has nowhere to build"

Where are this acres? are they next to the Lamu port and to what extent?
