What does the law say?

KNEC Act 2012 10(1)(b)

Functions of the council shall be...

(a)....

(b) Award Certificates or Diploma to candidates in such examinations; Such certificates or diplomas shall not be held from the candidate by any person or institution.

That may be so, though I think its debatable, but then a responsible person needs to think through the whole process and consider all the possible subsequent scenarios.

Are we likely to end up hurting society more or shall we draw more benefits.

For starters, why doesn't KNEC give out the docs direct to the student upon proper identification!!

Ideally, the secondary education should be affordable for all. The tuition part and everything to do with the exams should be met by the govt, and I think that is where the sector is moving to. The recent task force realised that the education is too expensive, not because of tuition and such other crucial things but coz of other things that are not necessarily important. Imgn someone being denied a cert because he was unable to finish the games/school bus/teachers gifts/drama fees and maybe this boy never even used that bus for even a day!!! Its a tricky area anyway and I think the task force is already working on the secondary school fees pricing...

This law is not cast in stone!

Your question was clear, "Under what law?" Now I need to check on the dunderhead part, whether he is one or not. Either he is a dunderhead, or whoever is calling him so is...Well, I dont think he got a first class, but as law is concerned, he is right. That I doubt is dunderhead.

Even when you have a land title of your own, someone else can hold it till you pay your debt to them!

@Ngalaka you will torture yourself for no good reason trying to explain some things to guys who graduated with diplomas in massaging humongous asses.

That pegged woman in Sudan was supposed to be stoned to death since she violated the local laws, but reason prevailed...#dunderheads cant see any need to reason on this @Ruto's directive. Sheria lazima ifuatwe.

A middle ground should be found.

The Government can quietly negotiate with the Teachers to explore various options.

Issuing a fiat in the way Ruto did is not right. Consider the ramifications going forward!

Who will pay fees anymore!

Again Head Teachers may choose not to allow any students with fees balance to stay in School.

What agony to Parents and loss to Students will that be.

Ruto may then be compelled to issue yet another fiat that no students to be sent home for school fees - then some schools grind to a halt.

Zero sum game!

Am surprised you have responded...Some comments are too low they just need to be ignored. The bar is at the same level with the ground...One has to dig deeper to fit.

If sheria lazima ifuatwe then Ruto is right in issuing the directive as Washiku has correctly quoted the relevant Act
