When you go get a mortgage, the mortgage company is supposed to value the land.
The first step in valuing property is to check for proper title.
Now any fool could have checked that title and seen that there was no conveyancing done. It was as clear as daylight. It was in the damn Ndungu Report.
So the bank did not do its due diligence. In which case they violated their fiduciary duty to their client.
Or the banks and the architects and developer were involved in the scam.
But at the end of this month, they will send a mortgage note to the owners of these houses that are no longer existing.
Woe unto you if you don't pay. You will never get another loan in Kenya.
So you were duped.
You have two choices. Shut up like those fools in Syokimau who were told to be nice by the same family that sold them fake land.
Or 2, take everyone to court. Don't listen to professional opinion. They are compromised. Only a stupid architect can build a house in land that doesn't belong to the lessee.
Sue everyone, the companies, the individuals and their mother. If the person sold you the land based on a fake title, then let him go sue the one who sold it to him.
You take care of your own first. If you don't you will have lost a house plus your mortgage payment every month for the next 20 years.
