LSK petitions Parliament for AG removal over Anglo LeasingQuote:The Law Society of Kenya has petitioned Parliament to start proceedings for removal of Attorney General Githu Muigai from office over Anglo Leasing contracts.
In the petition dated May 19, LSK wants the AG sacked for violating the constitution and gross misconduct.
“Your humble petitioner pray that Parliament looks into this petition and be satisfied that it discloses reasonable grounds to advise the President of the Republic of Kenya to commence the process and tor to remove the Attorney General from Office,” the petition read.
The petition comes after President Uhuru Kenyatta ordered the National Treasury to pay Sh1.4 billion to Anglo Leasing firms.
President Kenyatta also blamed the payments on the AG and demanded the office to “up their game” in fighting the country’s legal battles abroad.

In the petition, LSK alleges that the AG failed to respond to five letters by a foreign advocate in England who had been hired by the Kenyan government to defend the suit.
LSK further alleges that the AG delegated powers and instructions to the Solicitor General Mr Njee Muturi to represent the country while aware that he (Mr Muturi) does not have a licence to practice law in England or Wales.
The AG is also accused of failing to appeal against a ruling delivered on December 20, 2013 ordering Kenya to pay. Dunia ni msongamano..

The revelation formed the core of the President’s argument that Kenya had no choice but to pay Sh1.4 billion to two controversial firms, after losing cases to them in London and Geneva.
“We must up our game so that our counsel can stand by what all Kenyans including myself believe that we should not be paying this and we need to be able to win all those court battles in the courtroom,” he told journalists at State House, Nairobi. The AG's office when Anglo leasing was being signed, it's wako who was in office. Uhuru is blaming Githu! In any case the issue is not so much about the happenings at inception or the initial legal advice on the integrity of the agreements. It is the way the court matter was handled leading to the loss of the case - hence Uhurus pronouncement - "UP YOUR GAME" obviously directed at Githu. Quote:“It appears like the Attorney General followed the advice from Cabinet and instructed the foreign lawyers, with expertise in complex commercial litigation, but after 2010, that is when now we take over as Kenyan lawyers in the office of the Attorney General,” said Mr Mutua. “To a very big extent, the buck lies with the current Attorney General,” said Mr Mutua. Mr Mutua said that in December 2013, as the date for the judgement neared, the State Law Office failed to respond to five letters from Kenya’s lawyers in London seeking instructions, which enabled the judge to strike out Kenya’s defence and make a judgement against the country. He said the lawyers from the firm of Edwin Coe wrote to the AG saying that Kenya was handling the case “in a very casual manner. “There is a lot of money involved, I don’t seem to be getting adequate instructions on the matter and I’m concerned why the AG is handling the manner in a very casual manner,” read one of the letters. Mr Muturi then appeared before the judge in London and was allowed to act on behalf of Kenya despite the fact that he did not have a certificate to practice in the United Kingdom and Wales, making his submissions invalid. “We have been hurt as a professional body because of misconduct by our colleagues. Secondly we believe there was a conspiracy that was hatched in Kenya and went to London and it may have involved judicial officers,” said Mr Mutua you are right. given the circumstances of the case, he clearly threw the current office under the bus.

Pork's and Dpork's narrative on this matter has been shifting as per their expediency! Shafting us all through while we sing their praises. What I am not sure of is if its tribalism or sycophancy! Just as absolute power corrupts leaders, so does absolute fanaticism blind the people from logic

My thinking is Rotich is safe - as long as he merely implements what his boss - Pork has directed him to do. In other words, Pork has to give express and written word. Just as absolute power corrupts leaders, so does absolute fanaticism blind the people from logic

That is the catch and he had better make 1000 copies of that document! In the business world, everyone is paid in two coins - cash and experience.
