I don't think the law is necessarily the problem but just plain lack of common sense. Courts can issue arrest warrants based on laws and the police are mandated to obey them but don't forget that though we use the terms courts and police there are actual human beings, people doing this tasks...... and any place where you are dealing with human beings you have to be tactful about how you deliver the message.

I am sure there is something called conjugal rights in marriage but a man does not go home and say, "Mama Waitherero, kuja hapa toa sur*ali nipate haki yangu mara moja!!!" Even rights have to be tactfully negotiated for.

So even as the courts want to dispense justice issuing arrest warrants is just one of many ways to get there. It is however abrasive and can easily incite non cooperation. Remember that the courts need the police and the police need the courts so a greater respectful engagement between them will yield better results. Wakianza kurushiana mikono sisi sote ndio tutaumia.

I need not say more. Common sense is the word. not that I like Kimaiyo but in this instance I support him. Some of these warrants are just BS.

Inspector General of Police has denied making a statement to the effect that he cannot arrest Interior PS Mutea Iringo. Kimaiyo said his officers act on all court orders once they are served to the National Police Service as per the law.

“Contrary to the media report on the social, electronic and print media, I want to make it clear without any contradiction that all Court orders once served to the NPS must be executed in accordance with the law, therefore no one is indispensable that cannot be arrested and prosecuted. Once the warrant of arrest is imposed we shall act accordingly,” Kimaiyo said.

On Tuesday, police spokesman Masoud Mwinyi was quoted saying that the police cannot arrest Iringo despite a court order. At least three warrants of arrest have been issued against the PS over his ministry’s failure to settle debts awarded to different people by the court.

Last month, High court judge George Odunga ordered Central police chief Patrick Oduma to arrest Iringo after he failed to turn up to court. Another warrant of arrest was issued against the PS arising from a Sh780,000 compensation awarded to a police officer who sued the state for malicious prosecution after he was shot, arrested and charged with robbery but later acquitted for lack of evidence.
