And that prosecutor had the guts to suggest that the AG should be fired for failing to discharge his duties (read failing to provide bank statements of the indictees).

Later, Lawyer Stephen Kay (representing UK), points out that the prosecutor never requested for bank statements rather the prosecutor's office asked for identification of bank accounts of the accused.

In short, the prosecutor's office is making excuses for the failure of their case instead of admitting that the case collapsed due to lack of evidence.

What do you mean the AG can't resign? Anyone who is unable to dispense their mandate including the president can resign. Otherwise this goes against their basic rights.

The president can fire anyone he wants, including the CJ and the deputy president, all he needs is a good reason. What he can't do is wake up and fire constitutional office holders coz he does not like their faces anymore.

Having said that, Githu Muigai is not fit to lace Amos Wako's boots as far as being the AG and understandnig the law goes. Wako is without a doubt one of the most briliant legal minds Kenya has ever had.

You are wrong.Ask within the legal fraternity or the students who were in Parklands in 2004,2005 especially those he taught course units.

Amos Smiley Wako was the worst AG Kenya has ever had...

His decisions and advice were purely based on the politics of the day for all the time he was the AG. The only landmark decision he ever made in his tenure was terminating high profile cases using the Nolle Prosequi weapon...
...besides, the presence of a safe alone does not signify that there is money inside...

@mawinder, there is no need to ask for personal opinions, just profile their careers.

Review legal opinions that have been issued over their careers, you will realise that Wako has had to literally pull a rabbit out of the hat on many occasions to bail out the Mo1 and kibaki regimes.

Githu is probably a more popular law lecturer, but ain't a better legal mind.
