This is a war the j..s.c lost in the public arena. Even the common man does not believe j.s.c is innocent of the same crimes they have accused of Shollei and if they didn't know that is even worse. I didn't understand their decision to spurn parliaments summons.
I have some questions;
How do you interview and appoint somebody and then the same person turns around and tells you they are independent and cannot honour your summons?
What are the checks and balances for?
Does it mean checks and balances mean you do not honour the others summons ?
Does mean the judiciary is a law unto itself?
if it cannot be summoned why does it summon parliament to discuss the same issue they refused to discuss with parliament?
does it mean they can summon parliament but they cannot be summoned by parliament?
J.s.c made a serious mistake in their war plan, they entered into war without a clear goal of intended purpose other than dismissing shollei. They forgot who approves their salary, who appoints them. They forgot they have an Achilles heel, they are not politician's. they therefore cannot politic and lie, cause if they do, they will have lost all public respect and the support of the people. It's time they called a truce and save any dignity they have as an institution.

The integrity and impartiality of
the members of the tribunal has
also come under sharp focus.
Justice (rtd) Ringera, for instance,
had applied to be a judge of the
Supreme Court in 2011. However,
he was not shortlisted and publicly
attacked the JSC for snubbing him.
He even threatened to sue the

TNA ticket in Seme Constituency
without success while Mr Kilaka
was the Financial Secretary in the
Treasury when President Kenyatta
was the Finance minister.

Shollei must be having the last laugh , I am sure she will be more than willing to give her dosier to the tribunal.

The appointment of the tribunal to investigate JSC legitimizes Shollei's position that she was framed and sacrifficed.

Ahmednasir's arrogance does not help matters for JSC.

You are right maka this is not about impartiality and justice it's about winning. The tribunal was not set up to be impartial it was set up to settle old scores and ensure parliament and executive is respected and had its way. It's not about law, justice, independence or the constitution, it's about who is king.

Now let's see how the decks are stacked;
Who is behind the tribunal
parliament who hold appointing and dismissing powers and the purse strings.
it's voters majority who are gullible and believe their member of parliament is right.
The executive who owe their power to the support of parliament.
I don't believe our greatest rebel raila. i know deep down he wants the j.s.c members out especially justice mutunga, his betrayal was too deep to forgive, but its an opportunity he cannot ignore and he will run with it. To raila it's a win win situation and he cannot believe his luck.

Now the judiciary
It is supported by the legal fraternity who i know are divided by this issue but because this is where they earn their bread are going to try and 'save the situation'.
The civil society who are on a back track.
The media who are fighting for their independence.
The last two need an independent judiciary to fight their forthcoming battles and judiciary needs them to amplify their case in the public arena.

Now let the games begin!

if the JSC is the judiciary, IEBC is the voters, PSC is parliament and TSC is teachers. using the same permutation what is SRC? treasury? while the JSC comprises of judges and lawyers IT SHOULD NOT BE CONFUSED WITH THE JUDICIARY!!

I think this is a big win for Mutunga. I guess he approved the presidents's action. In my view he has now managed to get rid of judicial power brokers.....if i remember correctly there was an allegation he called them a rogue JSC at one time. Another win for him.... he has managed to get rid of Boss the judicial power woman. That is not a mean achievement for CJ..... He now has a chance to become his own man..... the real president of the Judiciary.

I dont think so, CJ is getting into bed with these people. He should not be surprised if he gets shafted soon.
