Now that you have picked up your concrete goggles, this discussion has lost all meaning. What would you have said if it was baba who was embarassed?

Law doesn't operate in a vacuum. It doesn't tell a judge EXACTLY what to do, but guides him/her to make decisions within preset parameters/limits.

This judge chose the punitive end of the parameters and it's hard to ignore the thick goggles he donned as he read out his malicious opinions.

The guy who set free suspected terrorists was within law, but that was the most stupid thing I ever heard from a judge.

Judge Anthony Ombwayo (formerly Senior Principal Litigation State Counsel) was correct to decline the invitation to accept evidence de-bene-ese from Kibaki coz the grounds in law for such weren't raised. It can't be the only grounds for Baks to give evidence even before the Plaintiff has opened his case and that he's the former president and he is old! Dr. Kamau Kuria knew better!


I agree. Plus procedurally shouldn't this have been dealt with in a formal application prior to the date of the hearing?

I think GKK is guilty of professional negligence and responsible for embarrassing Baks.

You see boy, everything is being considered on its own merit not globally...

Kibaki's case was unique at the time it happened and as such there was no need of comparisons with the past...

From the tone of your post it is obvious that you are one hell of a selfish man who cares nothing about anyone else but yourself...Suppose it was your old man?? Would the response have been the same?? Most likely yes!!!


You fail to get my simple point, a subsequent post has also shown you that Kibaki's request (from his lawyer who should know better) had no standing in law
