I can bet my last coin that this case will collapse...not because there is no case, but because the investigations were flawed...Just the way CORD had a strong case in the presidential election but our evidence was not in one piece, of course due to frustration from the government. The Kenya Gava has made this case so so difficult for Ocampo first and now Bensouda... Don't be surprised when no witnesses turn up on Tuesday!!! But again as I have always said, let the two gentlemen come home in one piece...what happened to simple forgiveness...Haven't they been tortured enough so far? And aren't they doing enough to the IDPs...When will we ever move forward as a country...You want to tell me that for the next two years nothing will be happening other than taking about Hague!

Hague really deflates these guys. Kwanza in the courtroom usually they look like they will drop dead in the next few seconds. Its no joke.
Lord, thank you!

At least 33 witnesses have pulled out of the case facing Deputy President William Ruto and radio presenter Joshua Sang’ at the International Criminal Court (ICC).

Victims legal representatives in the two case Wilfred Nderitu said the withdrawals have been occasioned by the fact that some of the witnesses are not sure of their statements.

Speaking yesterday, Nderitu, however, said the manner in which the prosecution has been losing witnesses is not worrying because there are still witnesses willing to testify before the court.

Nderitu said they have lined up 60 witnesses with 37 lined to testify while the remaining 13 will be called when need arises.

Monday September 9, 2013 - Panic mode engulfed the International Criminal Court (ICC) headquarters over the weekend, after four ICC witnesses who are set to testify on cases facing Deputy President William Ruto and radio presenter Joshua Sang, refused to pick their calls for them to attend the trials which commence on Tuesday.

According to our sources, the four witnesses, who were holed in Sweden and Belgium, refused to pick their calls since they were supposed to arrive in Netherlands on Friday.

The four have argued that unless the court allows them to testify outside the court, they will not be ready to “testify in an open court”.

adjourned till tuesday cz of witnesses no-show? didn't they know that the case was on today and that a day's sitting in icc is eqv to a middle class' 2 years rent?
ok here comes the start of a loong boring case, bensouda will grow grey hairs waiting for them to show face.

...don't quote me...the first witness who was scheduled to give the first evidence withdrew 6 hours before the start of the trials....

Why do I have a feeling that probably this could be the case. Those witnesses are not silly and they know for sure that any cross examination will leave sour tastes in their mouths and ICC's. Bora kuchukua pesa na kuhepa.

I will be difficult for a mortal kenyan to stand on that dock and agree to witness against Wailer or Johnny....this is Africa!!!!

You are blowing hot n cold, but I agree here. No sane man should agree to fix their president n DP with millions of supporters. Especially in such a useless case of no value to his motherland. That would be suicide.

So true. Suicide for them, death for their parents, children, siblings and all known relatives. They would all pay for this. I would never be a witness.
Lord, thank you!

DITTO! This is what informs my fear. I was just a boy in Matiba's 1992 bid. He enjoyed fanatical support. But since Uhuru was named as a suspect, I have been looking for a word stronger than fanatical to describe the support Uhuru has. I have seen the same with Ruto with Rift victim community forgiving him.

I wouldn't dare be a witness in these cases. I may hide in Trinidad and Tobago but ICC wont help hide all my relatives.

...True..I did not vote for him...but there is something I have come to like about him... I dont know what!!!
...Why would there be a delay in having the witnesses at The Hague for a case that has taken 5 years to put together? They should have been the first people to arrive there. Something is not cooking! Let us wait for Tuesday...You may see those chokoras you meet every day at Kimathi street as witnesses...Besoudas job is the most difficult in the world.

The witnesses have simply cowed out: Threats, money and fear!!!!
