Where on earth shall he go to?

We still have the Anglo fleasing guys to shield..............

The ghosts returned money and who wants to know whoever returned shs1B to the coffers............................................

Who wants to know the Goldenberg thieves when Patni is busy saving the souls of the sinners from the satans eternal furnace,who? and while at it,the AG,the chief legal advisor had said about Goldenberg that all is good anyway when the money was changing hands? And who will have to prosecute anyway? Should he shoot his own foot?.........................................

Who wants to know who stole maize when we have been given the Mpigs a clean bill of health?. And maybe the genuine complainants have died anyway..........................................

Why should he go when others are earning a salary,when they were in a system when the Mau complex was corruptly dished out to big fish?.........

Whom should he leave his job to when we are in a system of erred elections,and we finally went back to default mode of coalition,.............................

And now we are becoming a case study for other in Africa......................

Of course Ringera is a farce.

He is kept there ta safeguard the interest of certain politicians.
If we got a serious guy there a la Abdulnasir,the former LSK chair,corrupt fellows would get their knees knocking.

This includes politicians across the parties,even the very leadership of both ODM and PNU.

@jaheim,then what is the problem with Kenya? If corruption is the problem here,Kibaki is among millions of Kenyans who thrive in the practice. Now exit Kibaki from the Presidency and the alternatives make me shudder unless we have strong institutions. Our problems include institutional failures/weakness; negative attitudes; tribalism.

I believe Ringera is reaping the fruits of his own naivety...

He should never have accepted this appointment knowing very well that the buck does not stop with him... (stops with the AG)...

I forsee this happening to Kiplagat and his TJRC... People expect justice and Kip wont give it to them... two years down the line,we'll start asking what his huge salary was for..

As we clamour for the removal of Ringera,we NEED to take advantage of the situation and get rid of the biggest Elephant in the room... Mr. Wako himself

YES! He MUST go back to Integrity House! He is a harmless guy. The problem lies with Politicians. They complain whereas they dont pay tax,thus they dont own Kenya.

Pole kaka......are you a kin of Ring-error??.....Fact;If a court of law doesn't stop him,(By now you would know that the case will be in the hands of Msagha Mbogoli.The same judge Ring-error 'sacked' but was later to be cleared by a tribunal) parliament can either withhold funding of KACC and in an extreme,it can even have the damn commission disbanded.........It's a no winner for Ring-error and his godfather.To save himself,why not step down? Afterall,he will get a hefty send-off instead of muddying himself into oblivion.

What law did MK break?
.......Interpretation and general provisions act.

It's preamble?:
'an Act of parliament that makes provision in regard to the construction,application and interpretation of written law and general provisions with regard to such law and for other like purposes'.

Subsection (1) of Section 51 of the Act:

states that........... 'Whereby or under a written law a power or duty is conferred or imposed upon a person to make an appointment or to constitute or establish a board,commission,committee or similar body,then,unless a contrary intention appears,the person having that power or duty shall also have the power to remove,suspend,dismiss or revoke the appointment of,and to reappoint or reinstate,a person appointed in the exercise of the power or duty,or to revoke the appointment,constitution or establishment of,or dissolve,a board,commission,committee or similar body appointed,constituted or established,in exercise of the power or duty,and to reappoint,reconstitute or re-establish it.'

Subsection (2)

'Where the power or duty of a person under this section is exercisable only upon the recommendation,or is subject to the approval or consent,of another person,then the power shall,unless a contrary intention appears,be exercisable only upon that recommendation or subject to that approval or consent.'

This isn't space science...!!

Njung&eacute; you say ''This isn't space science''. You are right. It is the law and,unlike space science,the law is an ass because what appears so clear in the sections you quote may not be so clear. I read the article by a lawyer with similiar views on business daily,and the thing about lawyers is that when arguing their point of view it looks so convincing until you hear the other side with an equally convincing point of view. That is why there are judges and the matter is now in court.

@Njung'e.....This is not space science but the devil is in the detail.
I support the way the House is following up on this and the impending lawsuits. The Prezo must respect institutions for us to have good governance.
...So the gazette notice says it was an appointment but not re-appointment nor extension of term! The Prezo erred.

I have also read the article in the Business Daily where you might have picked those provisions of the Interpretation and General Provisions Act(IGPA)from.



What the writer of the article has conveniently not addressed are the provisions in the First Schedule to the Anti-Corruption and Economic Crimes Act (ACECA):



The procedure for appointment of the Director and Assistant Directors is as follows:


'8. (1) The Commission shall have a Director Commission,who shall be the chief executive officer of the Commission and who shall be responsible for its direction and management.

(2) The Commission shall have up to four Assistant Directors to assist the Director.

(3) The Director and Assistant Directors shall be persons recommended by the Advisory Board and approved by the National Assembly for appointment to their respective positions.

(4) On the approval of a person by the National Assembly under subsection (3),the President shall appoint the person concerned to the office in respect of which the approval was given.'



That procedure for appointment is what is caught by Sections 51(1) and (2) of the IGPA.

These provisions of Section 51(1) and (2) of the IGPA do not however deal at all with the issue of re-appointment.


Re-appointment is dealt which in the First Schedule to the ACECA. Rule 3(2)of the First Schedule provides:


'3(2) A person who has held office as Director or Assistant Director may be reappointed,but may not serve as the Director for more than two terms or as an Assistant Director for more than two terms.'


To the extent that re-appointment is not dealt with in Section 8 of ACECA(where approval of Parliament is required),it means that the provisions of Sections 51(1) and 51(2)of the (IGPA) do not apply to a re-appointment.


It is a very fine legal point but you have to read all the relevant provisions together to grasp it. The writer in the Business Daily has miserably failed to do this.


Lastly,I am not supporting the re-appointment of Ringera - all am saying is that it is not ILLEGAL. That question is very different from that of whether Ringera is fit to continue as the Director.

Was being told by someone that he had been stalling to be paid his dues.
According to the contract he signed,if he leaves KACC before his term is over,he should be paid the equivalent of his full term salary. Thats 2.5M multiply by 12 months multiply by the number of term years remaining. Do the math yourself. Crazy figures.

I thought the guy has not signed any other contract. The board was suposed to draw up another contract of which they refused so unless the guy is waiting for this month's salary. The 'big anouncement' is long overdue

Isnt there a clause in the contract that gives the employer (govt or otherwise) an exit or reserves the rights to cancel the contract? i dont think they would have a contract saying if terminated,he would be paid the full amount for the contract. May be some 3 months in lieu of notice and bla bla blas.... but for a full term that has not been worked? naaaah they cant be that careless.... or so i believe!
