To begin with when a firm I know was on record they always argued that Rosemary Wanja was not a shareholder or a director of Tatu. Therefore she did not have the locus to file a case against the company.
There was a guy called Josphat Kibogo Kinyua, who it was argued was a shareholder and consequently a
director of the company and had the necessary locus to institute and maintain proceedings.
If you take into account that the project involved the use of private capital to
construct a city using 200 billion worth of funds then the legitimacy of directorship was key.
