What exactly is the jurisdiction of the high court in this case? Is it to declare that Kethi is a registered voter and can therefore contest in the by elections? Or is it to rule on the validity of her registration details? Or is it to call for investigations into the activities of IEBC? I'm lost

this is a simple matter of jurisdiction!
when you want to know whether a person is a kenyan or whether an ID is valid or not - who do you ask? the registrar of persons.
if you want to know whether some entity is a company - who do you ask? the registrar of companies.
if you want to know whether someone is a tax payer - who do you ask? KRA.
if you want to know if an entity is a political party - who do you ask? Registrar of parties.
Driving licence? Registrar of Motor-vehicles
e.t.c.

SO WHO SHOULD KNOW WHETHER A PERSON IS A DULY REGISTERED VOTER OR NOT? CORD???

This a damage control strategy by CORD ie rush to court with a useless case now that their fraud was uncovered by the iebc. They are just looking for more opportunities to shift the blame from themselves to the judiciary and iebc, just like they did with the SC ruling.

I followed the proceedings and somehow agreed with CORD's version today. The point is, was it PROCEDURAL for IEBC to deny the gal her right?

Harun Ndubi: ''IEBC had duty to register voters and the method used should not be used to disenfranchise a voter. If a passport is expired, it is invalid for travel but can be used for identification purposes unless it is revoked. How can an expired passport and a photocopy of an ID fail to identify a voter?''

SOWETO: ''There was a conflict of interest and an actual bias. Once the IEBC said that Kethi wasn’t registered yet she insisted that she was a voter then the whole process is under question. Even after a complaint was lodged, IEBC did not make effort to contact Kethi. This poses question whether IEBC has something against Kethi or her party. IEBC was complainant and accused in the tribunal proceedings. A man cannot be a judge in his own case''.

James Orengo: The IEBC Tribunal was basically defending itself during the Committee hearing. “I would invite the Court to hold that there was no fair hearing and procedural error.”

Toa goggles. You do not repeat a lie many times and then it miraculously turns into truth.I can insist all i want that i am registered, presenting questionable slips of registrationLaughing out loudly ( from a book used to register the former PORK)but if i am not in the sytem, green, burgundy or yellow book, how can i be helped?.In the ruling of IEBC last week,i did not hear them even mention about expired pasport ID yada yada.... and that gab about her rights, well, had she exerciseed her right to regsiter as voter, this findeo would not be unfolding. But i am not a lawyer, just using my pedestarian view of things,so let's wait and see
I am happy

first hakuna kitu kama IIEBC, secondly - the matter of 'independence' is very subjective indeed.

hehehe @ magigi, the people focusing on non-issues are the ones still talking at length about expired passport and faint photocopies of IDs,but fail to do something very crucial;to point to their name ( or client's name) in Kenya's voters roll. This sounds ,nay, describes your corner. But again like they say,the law is an ass.....
