As a result of Mutahi’s tyranny of numbers and realisation that the election was as good as won during voter registration, RAilonzo realised that even in a run-off, they stood no chance of winning unless a fresh voter registration is carried out and they seek a way to beef up voter numbers in their strongholds. The main aim of the petition was thus to look for every reason to discredit the voter register and force a new process afresh. This being an uphill task already, they anyway thought that the legendary Oraro will manage to pull some trick up his sleeve in court and convince the judges. Their petition was therefore more self-seeking and not in utmost good faith, and any reasonable observer / judge could see this through their teeth.
I mean, why would anyone put the country at ransom without blinking an eyelid just to achieve their wildest dream? What is there to gain really?

When you present a petition filled with #%*@+ then what else would we expect except a unanimous dismissal??

Mind you not all petitions were thrown out... The acceptance of the "rejected votes" petition raised Uhuru's validity as president... Taking his win to 51.5%! (part of the reason for unanimous decision)

The proposal by this CORD MP will be swiftly thrown out by a Jubilee parliament and senate! Why do Cord Mps admit poor strategy on one hand and cry foul on the other?? Sad

ok, I have been devil's advocate. But clearly the decision was so easy for the judges. It is clear the petition was not well done Shame on you Shame on you

There were several weaknesses.

First, petition was weak, not well done
CORD rushed to get the evidence only after winner was declared.
The rushed like headless chicken, looking for copies of the important documents and forms.

Secondly, the constitution says
...if the election was carried "substantially according to the law". Right there "substantial" can be interpreted aither way.

Thirdly, the constitution
says a president-elect can be briefed immediately after being declared winer by Electoral commission.
So Uhuru had already been brief about many state affairs. Surely, this guy is now brivy to many statre secrets!!
NOTE: in some states someone like that will have to be eliminated because now he knows more than he should as a "shitizen".

Fourthly, high court is "political" court
They look at the big picture. The implication to the country. It has to make decisions by looking at many factors including the mood of the country.

Fiftly, RAO play his game by the book
He failed to realize that he was working against energetic, smart guys who were willing to stop at nothing to win this thing. And the guys had money d'oh!

Sixtly, CORD were over confident
They thought they were taking this thing.
NOTE: That's why they failed to prepare as per point (1) above.

Seventhly, there was no money for a run-off
You think the judges do not know about the impact of this to the country? So they decide in the interest of the country.

LESSONS LEARNT:
- Way before d-day, an candidate needs to look at both sides of the coin.
- One needs to answer the question: what if I loose?
- And start collecting facts about what can go wrong? What can my opponent do? What are the loop holes
- Come day of announcement, you have all the facts, you agents already give you all forms.

What you just do in the remaining days before expiry of seven days is to amend the affidavits and blah blah before closing final submission.

There's one issue i failed to understand though. Some of the returning officers were filling the total number of registered voters by hand. Didn't they have official figures of the total number of registered voters in each constituency? Or was this (filling by hand)only done at some polling stations?

i think this only happened at some polling stations. what is important is to revisit the discrepancies/shortcomings and see how to improve electoral processes because surely there is room for improvement.

still waiting to read the reasons given by the sc, but how bad can a lawyer get - if one can not even convince a single judge.
