The Supreme Court is relying on evidence filed with the case not after the fishing expedition when you have already filed the case. New requests are subject to a legal time frame.

Do we still need to go full trial if all major evidence have been time barred?

Waste of time to be honest, this isn't a free trial, its a joke.

All those things arent the backbone of the case...

Agree with maka. The 'real petition' or at least a large chunk of it is at KICC....

What have been disallowed are interlocutory applications. This SC is too rigid it has elevated the burden of evidence and adduction of documents to a fetish and is too reliant on technical objections

In matters legal, mimi ni mpita njia.So please enlighten me:-What is the backbone of this petition?

If the rejected prayers were to prop up the petition, what will happen without them??

The case starts after the ruling on the rejected votes!!!

Hii SC ikikubali sijui... The Constitution is very clear. Article 138 (4)(a) "A candidate shall be declared elected as President if the candidate recieves- more than half of ALL the votes cast in the election". What does ALL mean?

Orengo and co. trying to enter the tallying center? Exact figures may change but clearly the election was lost by at least 800k and maybe even a million. The recount should perhaps have included Rangwe constituency which had a 96.4% turnout - the highest in the country and an obvious red flag if one is looking for stuffing.

If I recall the highest turnout was somewhere is Wajir at 99.5%.

But Orengo does not do his side any favours. Bad behaviour.

Who remembers that polling centre in Rift valley which had 100% turnout? There were I think 9 registered voters, they all knew each other. There was one mlevi who had not voted by around 4 and they had to go for him to come vote smile

so is there a problem with that... 9 out of 9 ACTUALLY voting?

I hear the Constitution may be time-barred as the whole book will take too long to read...
