If the court accepts the ongoing submission about exclusion rejected vote, will we still have a case?

The case starts after the ruling on the rejected votes!!!

Orengo and co. trying to enter the tallying center? Exact figures may change but clearly the election was lost by at least 800k and maybe even a million. The recount should perhaps have included Rangwe constituency which had a 96.4% turnout - the highest in the country and an obvious red flag if one is looking for stuffing.

If I recall the highest turnout was somewhere is Wajir at 99.5%.

But Orengo does not do his side any favours. Bad behaviour.

That was the usual Robert Alai propaganda and have not seen anyone produce proof. At constituency level, Rangwe constituency is first followed by Lari as per the official record.

Do we still need to go full trial if all major evidence have been time barred?

Waste of time to be honest, this isn't a free trial, its a joke.

All those things arent the backbone of the case...

Agree with maka. The 'real petition' or at least a large chunk of it is at KICC....

What have been disallowed are interlocutory applications. This SC is too rigid it has elevated the burden of evidence and adduction of documents to a fetish and is too reliant on technical objections

I thought from beginning Kiraitu Murungi said it very well that you dont file a petition then you go out to look for evidence, rather you find the evidence then file the petition. Thats all what we call technicality else the respondents will feel aggrieved

Considering that the petition must be finalized 21 days from the announcement of the results (which is at most 7 days from the date of the election). 21 days are for 7 days of filling a petition, 14 days to do the responses and counter responses, pretrial, the trials and decision making must be done in 14 days. A bit too squeezed - right?

Which law is this?

Read the constitution please!

File WITHIN seven days.... Means you can even file two seconds after the announcement!

Decision WITHIN 14 days... Means they can even decide two seconds after you file!

It does NOT say file ON the 7th day; nor does it say decision ON the 14th day. The durations given are the MAXIMA.

much obliged - my argument is on the maximum length of time to be taken... your argument makes it possible to have the whole process process on the same day as the election result is announced. still buoying my argument that IT IS TOO SQUEEZED

Who remembers that polling centre in Rift valley which had 100% turnout? There were I think 9 registered voters, they all knew each other. There was one mlevi who had not voted by around 4 and they had to go for him to come vote smile

Boring...Just finding myself looking at these guy's unshaven heads...things must have moved from underwhelming to overwhelming!
This should have been undertaken at another time because the ruling will not change the overall outcome.
