My lay man interpretation:

The katiba is silent on how the P-elect should be 'handled' between IEBC declaration and swearing in. The closest I could get is:


Assumption of office of President.
141.
(4) Parliament shall by legislation provide for the procedure and ceremony for the swearing-in of a President-elect.

On the Acts of Parliament though, I found this:


PART II – ESTABLISHMENT OF ASSUMPTION OF THE OFFICE OF
PRESIDENT COMMITTEE
5. Establishment of the Assumption of the Office of President Committee
(1) There is established a committee to be known as the Assumption of the
Office of President Committee.


6. Functions and powers of the Committee
(1) The functions of the Committee shall be toβ€”

(b) organise for the security of the President-elect;
(c) organise for the necessary facilities and personnel for the Presidentelect;
(d) co-ordinate the briefings of the President-elect by relevant public
officers;

PART III – ARRANGEMENTS FOR ASSUMPTION OF OFFICE BY THE
PRESIDENT-ELECT
9. Security detail
Upon the declaration of the final results of a presidential election by the
Commission under Article 138 of the Constitution and section 39 of the Elections
Act (No. 24 of 2011), the Committee shall ensure that the President-elect and
Deputy President-elect are accorded adequate security.

10. Security briefing
The Committee shall ensure that the President-elect under section 9 receives
security briefings from the respective national security organs.

Why should a President Elect of Kenya travel by public means? What would happen to Kenya if something happened to him in a public transport? Who will be responsible for the possible mess that will arise? Think along those lines and you will see that traveling in an Air force jet is nothing to politicize.

Since commercial airlines are not secure enough for a real President, leave alone a president-elect, tell me, does Kibaki use the same jet for flight to say China etc?

There was a claim that 1.5 million votes were cast for UK and this votes were in excess of all the total votes cast for senatorial/gubernatorial posts!
I haven't seen that argument in the sworn affidavit/petition.

The most secure option available, like paying for exclusive cabin may suffice. The Air force does not own a presidential jet with that range of travel, in any case Uhuru has not gone to China as president elect. This is not an issue to politicise because the National repurcassions are too severe. Its that simple.
