I doubt if the whole election can be repeated in my opinion the courts will only rule on matters affecting presidential outcome since that is waht was presnted to it. However this opens up an avenue for any other Kenyans to explore the matter further by using this rulling.

the court may then nulify the basis through which the 50% threashold was
met and may rule that the declaration of a 1st round win was not constitutional hence a runoff and not repeat election.

Hi Wendz...Good thinking. But do we close our eyes as if nothing happened and pretend all is well and move on, wait for the next election with the same faulty electronic system and ill-trained IT guys? What should we do? For me it is good to tackle these issues and even if the court sees it too expensive and time consuming they should say so but point out the key areas that need to be improved, and chief among them would be firing the whole IEBC team. They duped Kenyans. My two cents!

Wendz is right. If the other presidential candidates decide to reverse their decisions (I don't think they will) then they will have to be included.

More critically is, if the verdict is that IEBC failed, would the same questionable IEBC carry out the repeat elections/run-off? I don't think so.
We would need to form a tribunal to investigate their conduct first as per the requirement of the constitution when dealing with an independent office. Now this would take months!

After 2007 GE, RAO was told to take his complaints to court. He has done that and we should be grateful that he has listened.

I don't think so. I strongly believe he would like to leave that office soonest. He has nothing more to prove or gain and he genuinely looks exhausted plus he's going to a life of pure luxury.

While it lasts. If this cases don't go anywhere, then WSR becomes the new driver, heck, he already is.
