Though the Supreme Court should have 7 members, he law requires a minimum of 5 judges to hear a case.

Since Justice Kalpana Rawal has not been appointed yet, there are 6 of them available at the moment. However we cannot have 6 of them listening a case together (odd number required).

I guess the CJ will appoint the other 5 to listen to the case. That is the most pragmatic way of doing it in my opinion.

You CANNOT stop any of them from sitting! We'll just have to hope they don't vote 3 - 3. Someone had foreseen this and argued that the DCJ should be replaced ASAP to avoid an even numbered Supreme Court! Nobody listened. To late!

But who in their right mind will vote in favour of petitioner?? It will be 6 - 0 to throw it out.

... They can't seat an even number. They will seat 5. Before hand they will have an election to see who will not seat.the President of the SC (the CJ) can't abstain,njoki ndungu ata express aweke maziwa kwa freezer this is a very serious matter she cant miss...now I see why someone wanted the CJ to pinch someone,s nose when he waz briefly stopped from going to TZ,make sure you dont eat your words later...
