If need be, a nominated Member of the National Assembly or Senate will be forced to resign to create space for him. Remember bwana dawa? He was forced to resign in 2001 to create space for UK. But this will only make sense if he is planning to run in 2017.
What if the court orders a run off and Kalonzo withdraws from Cord?Of course he has the option of his fellow mzee Nyongo stepping down and creating a by election for him.
The court
will not order a run off - you can take that to the bank! IEBC have done a tremendous job and it will be next to impossible to get any loophole to push for a run off.
Someone being forced to resign in a stronghold; now that is a definite possibility if Raila still wants to run in 2017!
By the way the IEBC included the spoilt votes even though
they were advised that that should not be the case to make sure there was absolutely anything one would fall back on to demand a cancellation or a re-run.
From 2017 onwards, the only votes considered will be the valid ones. You can quote me on that! IEBC will go to the supreme court for an interpretation before then, the supreme court will rule that ONLY VALID VOTES should be considered. This will be to avoid litagation in case one gets 50% + 1 without the spoilt votes and <50% if they are included. Luckily in this election it didn't matter.
Never count on making a good sale. Have the purchase price be so attractive that even a mediocre sale gives good returns.
