@thimioni......my above post are facts that were known to IEBC before the elections started.....why did they attempt electronic after this?

I'm still wondering how your lawyers will argue that the lack of phones affected your vote tally.

I'm no lawyer. So I'm assuming that for a suit to work it requires that you prove that your constitutional right was taken from you. You also have to show that the lack of electronic counting made the election unfree and unfair to your party.

Seeing that your votes were not transmitted electronically and that jubilees was also not transmitted electronically I know for a fact there are some 3 judges on that bench who won't listen to you.(ok that's a guess)

The playing field must be unequal to all parties.

What you would be attempting to say is that you had planned a soccer match with team B. On the day you planned it, the weather man said it would be sunny and dry. Unfortunately, it rained and you lost the game. Now you want the game replayed on a sunny day as those are the boots your coach had bought.

Electronic transmission or lack of it is not a constitutional right. Your right is to vote and have your vote counted. How that is done, whether with computers, balls in a box, markings on a blackboard or even pinky ponky is irrelevant.

I'm no lawyer but honestly, you had better be having evidence of intentional tampering of results by IEBC that was sytematic and aimed at making you lose the election.

That I have not heard.

@alma......tampering, that's the magic word, I promise you when the case comes up, that will be the solid base.....what I have mentioned above represent the basis.

Ok then,
1. how does the "tampering" affect the final official tally materially?
2. Did it unfairly award the other team votes that were non-existent?
3. Now that the elections will be announced as per what the manual tally is, how does the electronic malfunction play a role in "skewed" results?

Tampering by a polling official is an election offense. You report that to the police and the suspect is taken to court.

If I'm not wrong, there must have been over 1000 people employed temporarily by the IEBC. It is logical to think that there shall be those that will do something illegal.

But is that a constitutional issue?

You have to prove and I repeat. That the IEBC systematically tampered with your votes.

Lawyers like eating free money. None of your statements even comes close to this. All you guys are talking about is computer systems.

You have yet to show, that there is one result that is being given out by the IEBC that is different from your own agent.

That is the crux of a tampered election. Not 10 polling officers, some of whom support cord, who were arrested.

You have to show that Isaac Hassan and his IEBC team are busy right now decreasing your votes and adding them to jubilee and they had planned it to be so. Not that the computer system failed to work as they had planned.

Even the law knows that SHIT happens.

Just to add something.

If by some funny episode of the Simpsons you do manage to win and go for a runoff or have repeat elections, you had better be ready for the backlash from Kenyans who will think you are being frivolous.

If the turnout was high this time, you had better be assured that your opponents will whip their base so hard that even people in the ICU will be walking to the polling station.

There are those like me who may have been neutral before but believe that, there comes a time........fill in the blanks.

If you don't show me Commissioner Hassan himself chilling with Jubilee planning the stealing of ODM votes, you will lose miserably. Your own supporters will have given up.

The whopping would be one for the ages.

So weight your options properly. If you don't have evidence of tampering by IEBC, don't embarrass yourselves.
