No Seq Lu! 50% + 1 vote is the correct interpretation as in a majority.

On another note, for every rejected presidential vote there is a voter with an intention. Hence this issue now becomes contentious due to the unforseen large number of stray votes not considered.

Clarification:"To win in round 1,a presidential candidate must garner 50% plus one"---> 50%+1 means from 51% and above.

Is this true? thought it was 50% plus 1 vote :(

On principal, we are not counting nor determining the winner based on intentions. It is complicating things unnecessarily where we have clear valid votes cast.

Where is the logic in calling a spoilt vote a vote?

The same logic which makes us call a stupid person a person!

Not the same!
A stupid person can eat, cry, sleep and accuse... just like a person can;
A more apt analogy would be a dead and a living person.
A dead person cannot do the same things that a living person can do,in fact a dead person cannot do anything! same way a spoilt vote cannot do same things as a valid vote, it is dead and should not be able to do anything.
IEBC is giving a spoilt vote the same power as a valid vote to decide!

Both valid and spoilt votes are cast by living human beings.

@mwenza, u missed the point! Reference to dead and living was only an analogy to suggest that rejected votes are as good as dead (meaning of no use)

You are also missing my point.....the overriding factor is that both valid and invalid votes signifies the number of people who turned up to vote for a candidate.

Well said. But which candidate do the rejected votes go for? I guess answer is NONE!

Unfortunately that is the constitution. Like I have stated in another thread the constitution missed the phrase "valid votes cast".....it's too late to correct that now.

Wow. Looks like there are two separate other categories in addition to rejected, spoilt & disputed. If you add all them up total invalid votes coming to around 480,000 votes or 9.5% of the votes cast. Jamani, I hope I am wrong. Check the results from here

Ama Rejected is the sum of Spoilt+Disputed plus any other reason?

I really think the spirit of the constitution is not in line with the letter in this case. I pray that the courts will see this when the matter is brought before them, as it must

I think we have been mixing terminologies here and erstwhile in the media on this issue. It does seem Spoilt Votes are to be included and Rejected Votes omitted in that tally. Using some online definitions of the two, I regard a Spoilt Vote as a vote that is returned to the RO at the Station due to inaccuracies with the ballot e.g. printing not clear (voter issued with another ballot to fill) from IEBC hence including it in the tally doesn't change anything as its purely informational whilst a Rejected Vote is a vote that is rendered invalid due to actions strictly by the voter e.g. multiple markings or in our case wrong ballot box placement and should not be included in the tally. This way it would make sense. IEBC haven't explained it that way though so I could be totally off the mark.. As at 1725HRS we have the following votes flagged:
Spoilt: 224, 832
Rejected: 312, 368
Disputed: 208

Counting of votes must be a very difficult affair! at 1pm we had 38% of votes counted; at 6.36pm, we have 42.1%; I project that by 6.36pm tomorrow we will be somewhere like 68%.

What is really happening?
