50% + 1 is about the number of votes cast......are the spoilt votes CAST?

I was just about to ask this question. Is it 50%+1 of the cast votes or of valid votes. I see like this is what will determine run off or not.

Constitution of Kenya
.

Votes Cast = Valid Votes+Spoilt/Rejected Votes+Disputed Votes

Leads to absurd interpretition. A vote can only be cast in favor of someone. In a normal situation if an unqualified person votes, that vote would be disregarded.

Similarly, in a runoff if there were more spoilt votes than valid votes, does it mean there would be no winner or that "spoilt votes" will win since these are votes cast?

Some constitutions clearly state 50% + 1 of valid votes cast....ours says 50% + 1 of votes cast. I am no expert in law but I believe a rejected/spoilt vote was cast in the first place. We'll know from Mr Hassan by tomorrow midday.

...YOur interpretation is spot on!

For me it's a no brainer........the difference between "votes cast" and "valid votes cast" is enormous.
