Dear Kenyans

I have taken so much time thinking about this statement and I have decided to apologize to the people of Kenya.

When I was the Chief Prosecutor at the ICC, I came under intense pressure from countries that were funding my office to do something with the Kenyan violence. We did investigations, but we could not come up with a watertight case.

But former UN Secretary General Kofi Annan pressed my office to heavily rely on statements that had been collected by Justice Waki.

In addition, he gave me recommendations and names of people who were suspected of fueling the violence. The initial list had President Mwai Kibaki and Prime Minister Raila Odinga.

Politically, it was not viable to indict them, that is why we had to settle on the six. As of now, I regret why I succumbed to much pressure from the donors to indict the six Kenyans.

Let the truth be said. I hope my successor Fatou Bensouda who opposed the indictments in the first place, can have the courage to drop the charges.

Following Tuesday’s bombshell by Chief Justice Dr Willy Mutunga that the Executive is threatening the Judiciary, we at the Kenyan DAILY POST went ahead and dug more to reveal controversies surrounding the alleged threats.

Credible sources from the Judiciary said the controversy started in October last year when International Criminal Court (ICC) chief prosecutor Fatou Bensouda visited the country.

The sources said Mutunga and Bensouda held a closed door meeting at Mutunga’s private offices in Nairobi that discussed sensitive issues about the cases facing the four Kenyan suspects who were indicted by The Hague based court in connection with the 2007-08 post election violence where 1133 people died and over 650,000 were displaced

Immediately after the meeting, Bensouda who returned to The Hague that evening started sending emails to Chief Justice Dr Mutunga requesting for “help” to nail the four suspects.
At some point Mutunga, requested Bensouda to order a “warrant of arrest” Deputy Prime Minister Uhuru Kenyatta and Eldoret North MP William Ruto saying they are nuisance to the security of the country.

But Bensouda, who is a Gambian national, urged him that the Rome Statute has a provision that bars the court from arresting persons who are fully cooperating with The Hague based court.

Mutunga also requested the ICC court to write to the United Nations requesting for “peace keeping force’ during the March 4th election saying he does not trust the police since the force has not been reformed.

But Bensouda told him that the request must be made by the executive arm of the government but not by the ICC.

How can a letter that's meant to be an apology to a whole nation be a secret dossier?
