Administrative bureaucracies demand that all public officers traveling abroad whether on official duty or private affairs seek travel clearance. The mandate is drawn from the Public Officers Ethics Act together with the Code of Regulations thereto. The Constitution of Kenya 2010 however creates a distinction between Public and State Officers and most importantly gives prominence to the principle of separation of powers. The circular made it difficult for officers since it does not draw the distinction. I would have acted the same way in the circumstances.

This matter is dead and burried,it was interference, the fact is that an immmigration has nothing even to do with this ACT, the CJ has travelled out many times before, kubalieni yaishe, there was definitely intereference from some madeemoni, why apologize if the law is on your side????

I find it unacceptable for the CJ to refer to the officer by name rather than office. It sounds fishy

Uhuru and Ruto say they have confidence in CJ Mutunga and the judiciary, urge the govt to investigate the reported threats and prosecute the culprits!!!!

..even the circular quoted has nothing to do with CJ's travel, he simply said the officer tried to use it wrongly!!!

I have previously worked as a civil servant so i know it first hand.

This is why pple fail exams.Quote the specific constitutional/statutory provision or Circular referring to the above.Unless you either blindly live in the Kanu error or want to dig out old laws which suit your cause.

@keraka..Circular no.OP/CAB.8/19A now find out from Immigration what its contents are.

This law is designed to cordinate Government spending on international travel and ensure there is no vacuum/disruption in running of govt bodies.
In my opinion, they should have included the Judiciary since the other 2 arms i.e Legislature and Executive are included.
