Don't try too hard man, the CJ said there was no requirement on him like that, the ones who did it since apologised, funny you know the law better.....if the CJ was by any chance wrong he wouldn't have called that press statement!!!

... As I said earlier that the regulations are subsidiary legislation to the POA 2003. In the Subsidiary legislation there is a specific code of Conduct and Ethics for the Judiciary. Now if you read Rule 19 it states that 'A Judicial Officer and any other officer in the judicial service who at any time wishes to travel outside Kenya shall obtain prior permission of the Chief Justice'. The CJ is not sequestered in like manner...and I concur with what @mc reggae is saying the CJ is one of the brilliant legal minds we have inKenya he definetly knows what he is talking about...simply put that immigration.officer dint know what he/she was doing and overstepped their mandate

@maka..seems the immigration have not gotten the memo yet. Seems CJ was right on this issue. So Judicial officers get permission from CJ.

I Am alarmed by the incident that involved The Hon Chief Justice at Jomo Kenyatta International Airport (JKIA) with my officials, who insisted that he could not travel because he had not been cleared by Mr. Francis Kimemia. And would like to state the following;
1. The immigrations act only bestows such powers to the Minister for immigration to regulate travelling of foreigners and not Kenyans
2. The rights of any Kenyan to enter and leave the country at will are protected under the constitution. They include the right to acquire travel documents when required.
3. For Kimemia to purport to instruct my officers is shameful and I demand explanation.
4. In conclusion , while investigations on the conduct of the said officer are ongoing I would like to sincerely apologise to the Hon Chief Justice on the embarrassing incident.

The madeemoni harrassing the immigration officer to something illegal......you know the madeemoni, one of them had to call to apologise on another's behalf!!!!
