Read the statutes....
It the right of the accused to be present in the trial. That means the trial cannot take place if they are not present (That is why President Omar Bashir trial cannot take place until he personally appears in the trial to be able to question the witnesses.... as a right for him....if the courts final decision and ruling will be taken as valid.

However the accused can make applications to the court to be forfeit this right and be represented in the court.


Selective reading makes you conclude that all requests by the suspects will be granted at the courts......can make a request after appearing a request which can then (most probably) be rejected!!!!!



@Mc,
The statute says that the trials will be held at the Hague... But this can also be changed to another place by the decision of the court.

That is why UK and WR want to appear in the Hague as President and Deputy President elect....and make their applications. This is an international court and it has consider all the prayers given the decision by the people of Kenya (voters).


I agree, a lot of prayers will be literally needed here!!!!



Applications in court are referred to as "prayers". However you are right God answers prayers of His people when they pray.

PART 6. THE TRIAL
Article 62
Place of trial
Unless otherwise decided, the place of the trial shall be the seat of the Court.
Article 63
Trial in the presence of the accused
1. The accused shall be present during the trial.
2. If the accused, being present before the Court, continues to disrupt the trial, the
Trial Chamber may remove the accused and shall make provision for him or her
to observe the trial and instruct counsel from outside the courtroom, through
the use of communications technology, if required. Such measures shall be taken
only in exceptional circumstances after other reasonable alternatives have proved
inadequate, and only for such duration as is strictly required

You have always wanted UK to meet RAO at the Debe... why do you sound so elated at the possibility of UK not being able to be on the ballot because of the ICC?

You don't get it do you: UK will be on the ballot yes, but the news coming in will mean apart from his fanatics, no other sober kenya will touch the suspects hence will lose the elections!!!


How UK wins or loses the election will depend on his and Jubilee strategy. 1 day in politics they say it is a long time. Btw.... there is nothing wrong with a Raila presidency to me. He has been with Kibaki and he has some experience now.

My arguments here have been against the thoughts that ICC will help bring peace to Kenya.... and trying to use ICC to give some people a head start while we all know what happened in 2007.

Why should you be so excited about UK & WR getting arrested staying in the Hague?...or even being jailed there? Do you believe that will result in peace and unity in Kenya?

No thanks to Uhuru's&Ruto's headstrong approach. During G7 high days, all they needed was sponsor less polarising candidates to romp home with much ease. But they refused to heed any such counsel.
