Stop celebrating anything about bloggers. Ndemo and the CCK have again shown how uninformed they are about the internet and internet law.
In order to prove anything on facebook, you have to prove ownership. Just because some guys have confessed doesn't mean the next ones will. So you will have to ask facebook to give you data about their users. Good luck with that.
If the CCK is claiming that they can get data of a facebook user using IP addresses, then they are either not telling the whole truth or are gathering the data illegally. One thing is certain, if facebook gave out user IP's to 3rd parties without court orders, they will shut down their business tommorrow morning.
Mashada is a forum that is not hosted in Kenya but has Kenyans who comment there. In order to get the names of the people who comment there, you have to force mashada admin to hand them over to you. That creates problems for mashada admin, because they aren't governed by Kenyan internet law (which is non-existent) but where they are hosted laws.
The same goes for Kenyan list and the kenya daily post and even mashada.
But think about this.
So mashada admin agrees to hand over details of 1 of their most bigotted users. That opens them up to law suits from other users who can claim that their privacy has been compromised in the US courts. Those courts my friends have teeth, real teeth.
So admins have to decide to either sell out their users or have a few users who are law savvy who will finish their business in one swoop in lawsuits that will bankrupt them. Trust me, giving out information to 3rd parties especially if it is stated as such in the DCMA or terms of your website, is really really really frowned upon.

My unsolicited advice to those who wish to run online businesses is simple. Keep the servers in the US. It seems the Kenyan gov't has yet to understand the intricacies of law online. They are lashing out at anything and anyone.

I pity them online but they can surely do something on radio which we know are under Kenyan law.
Even if you had a blog that everyone assumes to be yours, its upto the complainant to prove it is yours. Good webmasters and hate speech mongers will run circles around you on that.
I'm afraid as usual, any action by the CCK on this issue will only make the hatemongers cover their tracks even more and only the ones in a while angry commentator will be taken to court.
