UMK and WSR will travel to the Hague as President and deputy President after being sworn in on 9th April 2013 if there is no runoff.
They will make applications on either to bring the case back to Kenya or have it postponed. This will be argued between their lawyers and the prosecutors and the judges will make a decision. If the judges make a decision to go ahead and proceed with the cases, this process will take start and the cases will be determined.
However given a situation where they are elected by Kenyans, their treatment by the court and international community will be different from how they will be treated as ordinary citizens.
Ocampo decided not to include Kibaki and Raila in the suspects because that would have resulted in a crisis in the governing of Kenya.

You are naive to think that the ICC can postpone a case (on what legal grounds?) or send it back to Kenya's judiciary(on what legal grounds?). Is there a precedent for this? No. Doing this would set a precedent that is indefensible morally and also from a point of law ...ICC is keen not to be seen as a joke. If they did this they lose the authority to prosecute anyone. It would be suicide for the ICC. Kenya took the case to ICC, the ICC did not independently decide to prosecute it, with members of parliament waxing lyrically on camera "Lets not be vague, lets go to the Hague". So ruling out these 2 possibilities, you would have us trust on the benevolence of these 2 to attend court and stick with the process to the end, and not expect turmoil back home regarding day to day governance, of which one of the consequences of said turmoil is likely to be an attempted removal ..? You have buried your head deep in the sand. It will not be business as usual. We don't need this.

It is clear that it will not be business as usual whether UHURUTO cooperate or not...... I still don't understand how anyone wants any of these 2 anywhere near storehouse?

Would be just and fair if the supreme court impeded on the ICC or vice versa?
If the answer is 'no', then Uhuru and Ruto have no legal reason to be on the ballot paper. Not because they are guilty or below our ethical qualifications, but because the courts shouldn't contradict each other, or seem to encourage contradiction.

You @BGL,...don't even have that one vote  ..may be the logic of that choice is not having to worry about things like the ICC and UHURUTO defying it. Fence sitting has its advantages.
