Swearing in of the new President

According to the Constitution, If there is no runoff, the results of the presidential poll must be declared within 7 days after the election. That means the latest this will happen will be on 11th March 2013.

The new president will assume office on the first Tuesday following the 14th day after declaration of results if no petition has been filed. That means we may have a new president on 26th March 2013.

If there is a run off, the fresh election must be held latest by 3rd April and the results of this election must be declared latest 10th April 2013.
This means the president will be sworn in on 30th April 2013.

If there is a petition filed in the supreme court challenging the election of the president elect this must be done within 7 days after declaration of poll results. Supreme court must determine and give a ruling within 2 weeks from the date of the filing of the petition.

If the Supreme court declares the election valid the new president will be sworn in on the first Tuesday following the 7th day after the decision of the court.
. This means Kenya will have a new President at the latest on 9th April 2013(if there is no run off) or on 14th May 2013 if there is a runoff.

There is a possibility that even if Jubilee wins the presidential poll .... UMK and WSR will go the to Hague on 10th and 11th April before they are sworn in as president and deputy president.

Current President is in charge until a new President is sworn in.

What if bail is denied? Will they be sworn in in the cells?

What if the ICC decides to have them kept in cell while their cases proceed!

Lacuna!

That's why they wont go to Hague!

But any way they aren't winning the election at all.

So I have been saying ....Assuming Jubilee win:
1) UHURUTO will refuse to show at the Hague, the ICC will issue a warrant of arrest, UHURUTO will disregard the warrant,..high pitched diplomatic noises and snobbery will follow, diplomats from the US and UK will be sent to meet PORK,...to no fruition, talk of sanctions will start, an ultimatum and schedule of sanction implementation follows,..somebody will move to impeach, PORK will buy off parliament and or senate by drowning the constitution and paying MPs Kshs 3.5 million a month.

We are going to be royally screwed IMHO.
2) To play devil's advocate,....Or who knows, they attend the hearing, and be holed up there for weeks on end, somebody moves for removal of PORK for physical incapacity to handle business by way of absence. UHURUTO see this, and to mitigate, see #1 above.

The ICC cannot just decide to have the suspects arrested on 10th and 11th April. The procedure requires the Prosecutor to make an application for the arrest warrants...the merits and demerits of this application will be argued in court between the prosecutor and the advocates of the suspects...and then the judges will make a decision.... to issue the warrants or not.

The prosecutor has not so far contemplated to apply for any arrests for the Kenyan case because that is normally done when the suspects fail to comply with the directives of the court.

Please do your research on how the ICC operates...so that you are not misguided.
