HELP! Plot bigger than what title deed says

I recently bought a plot which is bigger on the ground than what its written on the Title deed. what should I do?The plot is clearly marked and so are the neighbouring ones.ADVISE please

How big is the discrepancy? I'm no expert but maybe you should involve a surveyor from the Lands ministry who can advise you appropriately

How big is the plot ? What is the date of title ? my company bought one plot in coast and had the same problem,n we were told by surveyor in olden days when muzungu's were sub dividing the lands they dint have latest equipments so the plots were slightly bigger then shown on the title..... is your neighbour ok ? i mean is he complaining that you have encroched onto his plot ?

The title deed always reads '....measuring xyz hectares or thereabouts......'

So the question is: how large is the discrepancy? Can it be covered under the word 'thereabouts'?

Just out of curiosity; do you know the difference between acres and hectares? One hectare is equivalent to about 2.5 acres. Titles show the size of land in hectares.....

If the kaplot is a corner plot its bound to be bigger.Alternatively if lying next to waterland or river there would be a bigger difference.

Otherwise count yourself luck dude.

Ascertain the veracity of the information in the document of the title by conducting a 'SEARCH' at the ministry of lands. Usually there is an extra document attached to the Title called Deed plan.Take it to the Survey of Kenya just to be sure it corresponds with the original one. Otherwise consider this highly unusual. With land deals,if it reeks a little,be very suspicious. Take care.

The plot has a valid title deed and I have transferred it to my name. The Area Map Mutation from the Surveyors Institute show that the original land was divided into four equal pieces. The demarcations for the four plots are clear . My plot (and the other 3) measure 19mX44.3m on the Map Mutations and 27mX44.3m on the ground. Does this mean the surveyor assumed the size without measuring it physically or what? Why did he get it this wrong? The Margin of error is way too big!

Come to think of it. It might as well be a 'typing' 'Computer' error and one of my 'Plot' enemies is out to finish me economically huh!
