If a suicidal maniac jumps suddenly into the path of your oncoming car and you hit him/her,the law instantly considers you guilty .

It does not matter whether the pedestrian was totally drunk,a jajuok (night runner),plain careless,sick,whatever - hiyo itabaki ni story. If the guy dies,straightaway you get slapped with a manslaughter rap.

It matters a lot how you argue your case in court.
If the other side does a joke job of their case,they loose you win.

That's only a premise,- but you are still given your day in court. Depending on your ability to convince the court that you were not at fault you may get away with it.

there is shortage of seasoned judges in the high court and jailing GBM was not forthcoming.

get real people. did you honestly expect a conviction? and the kenyan law/justice is never all blind. it is all seeing and only on rare occasions is it ever blind.
