Accessing someone's funds

The (single) parent of somebody I know is incapacitated and has been in hospital this past week. The daughter has some funds, but won't be able to cover all the medical expenses by herself.

How would it be possible for her to access her parent's bank account? She can get a letter from the hospital describing the state of the parent. Would that be all that would be required?

I bet it depends on the bank itself. Why doesnt she go to the bank and explain her situation then they can tell her what they require. I bet she'd have to prove her relationship with her.

Am sure there are many bankers on Wazua and should be able to assist with requirements in different banks...

Someone help out... we just could need this info in future too.

Sorry to say this but the moment the bank knows that she is indisposed, normally the first reaction is to put the account on alert. So if she can get the ATM and PIN, it is the easiest route. If not then they have to visit the bank but banks are a tad slow to release money out of someones account to another person.

Thanks wazuans, will pass this info along. She probably has the ATM card already but might not know the PIN - will ask.

she will have to go to a lawyer who will file a case for her under the mental health Act.

Once the Court gives an order, she can then approach the bank and get the money.

otherwise it is unlawful for banks to release money to a third party.

even for a non mental health issue eg road accident, heart attack?

1. the patient can write a letter to the bank accompanied by a letter from a registered doctor.
2. If the patient is not in a state to sign, a registered doctors letter to the bank will work.

In both cases the bank will issue a bankers cheque directly to the hospital (No Cash). In most cases the bank sends the physical cheque directly to the hospital/doctor and not through the 3rd party.

The Hospital will sign an indemnity confirming the transaction and the circumstances sorrounding it upon receipt of the cheque.

In this case should the customer dispute the transaction in future the bank will have grounds to demand a refund from the hospital.

Let your friend go to the customer service desk for assistance.

Banks monitor suspicious transactions e.g. multiple maximum limit ATM withdrawals. And if you are caught withdrawing money from somebody's account it is treated as theaft/fraud.

remember they have CCTV footage of all transctions

@bwenyenye was correct,

Just got word that all the bank can do is put some kind of hold on her parent's account, so that nothing can be withdrawn or processed...
