I think we need the NCIC considering what we went through in 2007 but from what i have seen so far i do not think we have "moved on".

Rehabilitating rather than punishing them, given their popularity. They would be of more use to the society singing PEACE rather than spending our hard earned cash in the cooler, I think. And given they have a name to protect, they would be more than willing to change their wicked ways.

@simonkabz, They need to earn that by either apologizing/being remorseful or jail term.

This thinking is just crazy. We might as well try to rehabilitate the Ocampo 4, or the Bensouda 4

Going by these translations; I do not see any insults directed at any community, tribe or group of people. If there are insults, they are directed at ONE INDIVIDUAL known as Raila Amolo Odinga.

While that might constitute libel, it certainly doesn't qualify as "hate speech" as defined in the National Cohesion & Integration Act of 2008. [Read it here: RINK]

Is is very different from the alleged announcements made by KASS FM's Sang referring to a whole community as "madoadoa".

This is a sad day when three individuals make songs that MIGHT be insulting to a fourth individual and we start talking of one community [the Kikuyu] insulting another one [the Luo].

Shameful!

From the Act, hate speech is defined as:

Section 13.
(1) A person who-
(a) uses threatening, abusive or insulting words or behaviour, or displays any written material;
(b) publishes or distributes written material;
(c) presents or directs the performance the public performance of a play;
(d) distributes, shows or plays, a recording of visual images; or
(e) provides, produces or directs a programme; which is threatening, abusive or insulting or involves the use of threatening, abusive or insulting words or behavior commits an offence if such person intends thereby to stir up ethnic hatred, or having regard to all the circumstances, ethnic hatred is likely to be stirred up.

(2) Any person who commits an offence under this section shall be liable to a fine not exceeding one million shillings or to imprisonment for a term not exceeding three years or to both.

(3) In this section, “ethnic hatred” means hatred against a group of persons defined by reference to colour, race, nationality (including citizenship) or ethnic or national origins.


The highlighted part is quite telling.

You just couldn't stop mentioning the name Raila in your "shameful" diatribe could you?

We are not children here. Worse, some of us have children your age.

We know what that song was saying. We know what they were supposed to be interpreted as or were being interpreted us.

If you are so morally afronted, take yourself to the high court and picket for the rights of your 3 brethren. Even better go be their lawyer.

However, trying to say that "madoadoa" was bad, but "kihii" is ok is not only shameful, but silly and well beneath the dignity of a grown man like you who has managed to learn how to type.

Absolutely nonsensical.
