A mediation team, led by former UN Secretary-General Kofi Annan, oversees the signing of a power-sharing agreement called the National Accord and Reconciliation Act, which establishes a coalition government with Kibaki as president and Odinga as prime minister. It also set up the Commission of Inquiry on Post-Election Violence (CIPEV), which later became known as the Waki Commission after its chair, Judge Philip Waki.
October 15, 2008

The Waki Commission submits its report and recommendations to the government of Kenya; recommendations include the establishment of a special tribunal of national and international judges to investigate and prosecute perpetrators of the post-election violence. The report also states that if the tribunal is not set up within six months, information collected by the Waki Commission will be passed to the ICC, including a sealed envelope of names of those suspected to be most responsible for the violence.

Who exactly voted against the establishment of a local tribunal?.

They are:

Among those who voted against a local tribunal are listed as the following: Chepchumba, Cheruiyot, Ethuro, Gaichuchie, Gitau, Jirongo, Kaino, Kaloki, Kamau JI, Kamau J M, Kambi, Kapondi, Kariuki, Kathuri, Kigen, Kiilu, Kilonzo J K, Kilonzo J M, Kiuna, Kivuti, Koech, Konchela, Dr Kones, Mrs Kones, Kuttuny, Lagat, Langat, Lessonet, Letimalo, Linturi, Litole, M’Mithiaru, Machage, Magerer, Mbau, Mbugwa, Mututho, Mung’aro, Munyaka, Muoki I.M, Muoki D M, Mureithi, Murgor, Musyimi, Mwangi, Mwathi, Mwiru, Nguiyai, Njuguna, Onyancha, Ottichilo, Ruto, Sambu, Sirma, Waibara, Waititu, Wambugu, Washiali, Were, Yakub.

These are the fellows who should be blamed for shaming kenyans on the international stage. My guess is that at the time of voting they were very short sighted to take into consinderation the long term consequencies.

What is ICC fearing that if Uhuru and Uthaura shoul not be heard orally. Anybody can write a composition and earn marks but that does not mean they are good in elaborating the truth orally. We need to hear this thing live and not what was written when things were totally political

May be i tend to believe now more than before that this case is already pre-determine. The 4 should just go and ask how many years they will be jailed and start the jail term all together
