I dont think Banda conceded because of the ICC. ICC does not prosecute people who hold on to power nor those who rig elections. Neither will it go for those who call for mass action but those who plan violence.
However, the role of the ICC is a good-bad one. Good because it gives us the citizens of African countries the safety in knowing that even the mightiest of our leaders can be arraigned there if they organise mass murder, rape etc against citizens. You will remember Amin and that guy from Ethiopia Mengistu Haile Mariam. They killed and escaped to other countries where they have lived in peace.(ok Amin is dead but Mengistu is still in Harare).African courts will not usually nail any big fish.
The ICC however appears heavily skewed against the third world. Why on earth is everyone quiet on any of the cases by the US, UK, France & Italy? South Africa has petitioned the ICC to investigate UK, US and France over crimes committed in Libya. They are strategically mum about it.
