#CMA to appoint a third of directors - including chairman - to interim board of auto dealer #CMC Holdings. MD and finance director to remain
CapitalFM_kenya

News just in is Capital Markets Authority, in a first from the recent past, is appointing a caretaker board for CMC.

Will majority shareholder take it lying down?
Are investors in CMC protected and happy?
What direction if it starts trading?

Eish! They should have the A/EGM already so that CMA stops imposing itself!
STL has opened up a can of worms. Where do you draw the line?
Is EAPC next? Olympia maybe?
Did they do the same for Marshalls during the Pattni/Somaia wars?

@FUNKY 24hrs old, your link - perhaps you meant http://www.nation.co.ke/busines...0/-/j5plvxz/-/index.html

Business editors befuddled and must consult legal opinion for the 'locus standi' of CMA's move.

Interim board for 1 year with CMA assuming right to vet and appoint one-third directors plus chairman to board (representing who - CMA?). Further booting out all current directors mentioned in the report adversely.

Round 3: Mr. William Lay emerges victor
Round 4: Lawyers for both sides assured of more business

You have to understand you are in a country where Uhuru & Ruto can hold the presidency and are still having sold out rallies full of supporters..

Such a shame¡¡

CMA loves making a mountain of a molehill. Are they going to appoint somebody to rep CMC's largest shareholder? If not, this will go on for years just like Carbacid. Muthoka has deep pockets. CMA and the other two thugs Nd'ung'u and Kibe should go and find a buyer for Muthoka's stake. Offer him cash and then throw the whole Kenyan justice at him...

“The move is in total contempt of court following the orders that CMA sought and was granted on November 16, 2011,” said Fred Ojiambo of Kaplan & Stratton, the law firm that represents Mr Peter Muthoka, the lead shareholder at CMC in the suit against CMA.

Mr Ojiambo said the court had on November 16 issued two orders in response to CMA’s prayers -- that the CMC board could not be altered until the matter before court is heard and determined besides restraining the petitioner (Mr Muthoka) from holding a special general meeting.

“This means the composition of the CMC board cannot be changed until the case has been decided. CMA cannot act in breach of orders it sought and obtained from court,” he said.
