Not good news for KK... I hoped that KK would take over KPC... Of course, this matter will go on for another 1-2 years but eventually KK will win!

On the other hand, perhaps Ahmednasir might arbitrate this matter in a few weeks rather than a few months or years!

Commercial Court judges—Daniel Musinga and George Kimondo referred the dispute to the sole arbitrator Ahmednasir Abdullahi for reconsideration.

“We are satisfied that we should disturb the award for being so inordinately high as to represent an erroneous estimate,” said the judges in their ruling.

I dont get it so are we back to squire one? and the issue about the award being more than what the economy can absorb is the judge serious?...KK absorbed the said damage, that's why its claiming for what is rightfully theirs.

Merits of the case not in dispute, amount of award seems inordinately high according to the judges. KK will still get something, maybe less than what was proposed by Ahmednasir.

@GG. The case is back to the same judge. @Vvs. Would it not have been better for the high court to use other means to determine compensation to KK instead of taking case back to same judge.

KK will be OK... At worst, it gets a lower amount but even if the original award is reduced... by the time the interest is added in... $$$$

What do the judges mean the economy can't absorb the award? That's nonsensical since the money would move from KPC to KK - both are local firms.

As for KPC, didn't it pay for the Triton scams? Where were the judges in telling the banks/financiers & OMCs that recovering the money from KPC/Triton was too much for the economy to bear????
