So unless there is a refurendum, MK's term virtually expires on 30th December 2012. Hence we will have no President on 31st of Jan 2012!!!

This is what the ruling says in part 148

148. We must also point out that the term of the President is
preserved by section 12 of the Sixth Schedule. Section 12(1)
provides that, ‘The persons occupying the offices of President
and Prime Minister immediately before the effective date shall
continue to serve as President and Prime Minister respectively,
in accordance with the former Constitution and the National
Accord and Reconciliation Act, 2008 until the first general
elections held under this Constitution, unless they vacate office
in terms of the former Constitution and the Accord.’ This means
that any problem that may have been caused by the
incongruence of the term of Parliament and the President is
cured by the fact that the President and Prime Minister in office
remain until the first elections irrespective of the date of the
election.

On this, and only this i agree with Martha. It seems the quality of our judges is still wanting. They remove us from one fire and take us to another fire. Am not a lawyer but common sense dictates otherwise on these 3 issues. 1. The defination of election term (believe it should include the electioneering period since as a per the jugdes decision, 3 terms of 5 yrs each could consist of about16 yrs as opposed to 15 yrs)
2. They tried to create their own law instead of interpreting the national accord on dissolution of the coalition government which states that either party to the coalition can withdraw from the coalition in writting. They supposedly indicated both must agree contrary to the national accord and international best practices on coalition dissolution, and lastly 3. They did not anticipate the possibiliy of lack of executive arm of the government which puts the country at risk in early 2013, if elections are not held by end of this year.
