One person I'm sure is happy about the new elections date is IEBC Chair Isaak Hassan, now has ample time for preparedness.

"In accordance with Article 255 of the Constitution, an
amendment to the Constitution affecting the term of the
President cannot be effected into law without a
referendum."

So unless there is a refurendum, MK's term virtually expires on 30th December 2012. Hence we will have no President on 31st of Jan 2012!!!

...and what is your interpretation of the term of the president as far as the electioneering period is concerned?

Actually no. That poll was not even believable and political mischief was written all over it. But that being the case we can conclude that in these elections the incumbent is RO the throne is his to lose and it's slowly slipping away. Wouldn't you agree?

I think those high court judges have made a very grave error in interpreting law and should all be sacked.

It is a fact that Bak's term expires on 30th december. That is the same day we need to have the new president sworn in to start his/her new term.

Same logic applies to the mpigs.... we swear in new mpigs in january 2013...

so elections MUST be held before that time!!!
When I have money, I get rid of it quickly, lest it find a way into my heart.

So we have some half baked judges there.

an appeal could easily succeed any wannabe lawyer willing to win fame(customers and money) for winning a case on constitutional matters ?
December would have made more sense its only 13 January , we have all the time to prepare till Dec 2012.

I totally agree. An a appeal will 99.9% go through and elections will be done in December 2012.

Does the constitution foresee a situation when there is no president? If so, what are the contingencies it has in place?

In my own view and wisdom ,the president will disolve the coalition on September (from 26th -27th) then 60 days will apply for the IEBC to hold an election. In this way,we shall avoid a situation of no president over some period coz another president will be elected on or around December 27th -28th 2012.

After dissolution,there will be no prime minister but a one part government.
